Terms and Conditions
Part 1 - This Agreement
1.1 Overview This User Agreement ("Agreement") represents a binding legal contract between you ("User") and Lief World Ltd ("the Platform"). The Platform is a comprehensive hub designed to facilitate and promote philanthropic activities by connecting Users with registered charitable organisations. The services provided by the Platform encompass a range of functionalities, including the management and tracking of charitable contributions, facilitating financial support to verified charities, and offering tools for engagement in fundraising and other charitable activities.
1.2 Acceptance of Agreement By accessing or using any services, features, content, or functionalities offered by the Platform, you acknowledge and agree to the terms set forth in this Agreement. Your use of the Platform signifies your binding acceptance of these terms, including any modifications made as per the terms of this Agreement or any additional policies and agreements you may enter into with Lief World Ltd in relation to the Platform. Should you disagree with any part of this Agreement or fail to comply with its terms, you must immediately discontinue your use of the Platform.
1.3 Platform's Role The Platform serves as an intermediary, facilitating connections and transactions between Users and charitable organisations. While the Platform may provide tools and resources to assist in these activities, it does not directly engage in or take responsibility for the actual charitable services or actions taken by Users or organisations through the Platform.
1.4 Legal Entity and Jurisdiction Lief World Ltd is a limited company, incorporated in England and Wales. Interactions and agreements facilitated by the Platform are subject to the governing laws and regulations of this jurisdiction, including compliance with any legal obligations.
1.5 Intermediary Compliance In conducting its operations, the Platform adheres to all applicable laws and regulations, including but not limited to, those related to charitable contributions, data protection, and payment processing. The Platform's integration with payment services, such as Stripe, is in strict accordance with the respective service providers' terms and policies, ensuring secure and compliant financial transactions.
1.6 Amendments and Updates The Platform reserves the right to amend this Agreement at any time, in its sole discretion, to reflect changes to the law or changes to our services. We will make reasonable efforts to notify Users of any significant changes. However, it is your responsibility to review the Agreement periodically for updates.
1.7 Entire Agreement This Agreement, including any future modifications, as well as any additional terms and conditions associated with your use of the Platform, constitutes the entire agreement between you and the Platform. This Agreement supersedes all prior agreements or communications between you and the Platform regarding the subject matter herein.
By continuing to access or use the Platform after those revisions become effective, you agree to be bound by the revised Agreement. If you do not agree to the new terms, you must stop using the service.
Part 2 - Platform Services
2.1 Comprehensive Suite of Charitable Services The Platform offers an array of services aimed at streamlining the process of charitable giving and engagement. Our comprehensive suite includes:
A robust infrastructure to facilitate financial contributions directly to registered charities.
Interactive tools enabling Users to organise, participate, and track fundraising events and challenges.
A resource centre providing support for broader community engagement efforts.
Each service is designed with the intent to foster a vibrant ecosystem where charitable endeavours can thrive through collective action and support.
2.2 Detailed Service Descriptions Our services include, but are not limited to, the following:
Financial Contributions: The Platform facilitates the flow of financial donations from Users to registered charities. This process is augmented by our partnership with Stripe for secure payment processing.
Fundraising Tools: Users have access to a suite of tools to create, manage, and promote fundraising initiatives. These tools are intended to amplify the reach and impact of charitable campaigns.
Community Engagement: We provide resources and opportunities for Users to contribute to a wide range of causes and community efforts.
2.3.1 Full access to Platform Services The Platform’s services are accessible to:
Charities within the Charity Commission's database who are registered on the Lief platform (“Registered Charities”).
Individuals who wish to contribute to charitable causes.
Businesses seeking to partner with charities for social impact initiatives.
2.4 Registration with the Platform To access the full range of the Platform’s features, Users may be required to complete a registration process, which involves:
For Charities: A comprehensive registration to become an approved partner, including due diligence checks to ensure compliance with legal and financial regulations.
For Individuals: An optional registration to access personalised features and track contributions. Non-registered individuals can still donate but must provide a valid email address for transaction receipts.
For Businesses: A vetting and approval process that allows for partnership and engagement in various charitable activities, along with the provision of analytical tools to track their contributions and impact.
2.5 Service Limitations and Provisions The Platform reserves the right to modify, suspend, or discontinue any service or feature at its discretion. Users will be notified of any significant changes to services or terms of use in a timely manner.
Part 3 - User Registration and Roles
3.1 Charity Organisation Partnerships Charities seeking to partner with the Platform must undergo a comprehensive registration process to ensure alignment with our mission and compliance with applicable laws. This process includes:
Verification process with company email stated on the charity commission.
Completion of the Platform and Stripe Connects KYC process.
Agreement to compliance monitoring carried out by the Platform.
Once registered, charity partners gain access to a suite of tools on the Platform, including:
Creation of a dedicated charity page to showcase missions, projects, and needs.
Engagement with fundraisers through partnership opportunities.
Insightful analytics on donor behaviour and campaign performance.
3.2 Individual User Engagement Individuals may interact with the Platform in multiple capacities:
Non-Registered Users: Individuals can make donations without creating an account, provided they supply a valid email address to receive transaction confirmations and for further communication.
Registered Users: For a more personalised experience, individuals may create an account which enables them to:
Track their donation history and measure their social impact.
Receive updates and stories from charities and ongoing fundraising events.
Access exclusive Platform features designed to enhance user engagement.
3.3 Business Involvement and Contributions Business entities interested in contributing to charitable causes through the Platform are required to:
Complete a vetting process, which may include submission of business credentials and an outline of intended charitable activities.
Upon approval, businesses can:
Participate in and initiate fundraising activities.
Access detailed analytics to gauge the impact of their charitable efforts.
Utilise a unique Business ID system for transaction tracking and reporting.
3.4 Account Security and Maintenance All registered users, whether charities, individuals, or businesses, are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account. The Platform provides robust security measures to protect user accounts, which include:
Secure login processes.
Regular security updates and alerts.
The option for two-factor authentication to further secure accounts against unauthorised access.
3.5 Compliance and Conduct All users must agree to engage with the Platform's services in a manner that is respectful, ethical, and in compliance with all applicable laws and this Agreement. The Platform reserves the right to suspend or terminate accounts that are found to be in violation of Platform policies or legal requirements.
3.6 Updating User Information Users must ensure that all account information remains accurate and up to date. This includes promptly updating the Platform in the event of changes to contact details, legal status, or other pertinent information that may affect their use or the operation of the Platform.
Part 4 - Payments and Donations
4.1 Secure Payment Processing The Platform partners with Stripe to provide secure and reliable payment processing services. Users making financial contributions through the Platform can do so with the confidence that their transactions are managed by Stripe’s robust payment system, which adheres to the highest industry standards for security and compliance. As part of this partnership:
All transactions are facilitated through Stripe Connect, ensuring a secure transfer of funds.
The Platform does not store any credit card or banking information, maintaining compliance with the Payment Card Industry Data Security Standard (PCI DSS) and General Data Protection Regulation (GDPR).
4.2 Transaction Fees and Contributions For every transaction processed through the Platform, the following fees are applied:
A standard processing fee of 1.5% + 20p per transaction, which is subject to change in accordance with Stripe’s pricing.
Users have the option to cover the processing fee to ensure the full donation amount is directed to the charity.
Users may also choose to support the Platform’s operations and development by making voluntary contributions on top of any charitable donations.
4.3.1 Donation Payouts to “Registered Charities” Charities partnered with the Platform receive donations based on the following payout rules:
Regular donations are made available for payout on a 7-day rolling basis.
Payouts for fundraising events or campaigns are made available on the completion date of the fundraise or after 90 days whatever comes sooner. It then becomes available in 90 day cycles unless selected otherwise by the User in charge of the fundraise
The Platform ensures that all funds are disbursed to charities in a timely and transparent manner, with clear communication provided to both charities and donors regarding payout timelines.
4.3.2 Donation Payouts to “Unregistered Charities” Charities not partnered with the Platform receive donations based on the following payout rules:
All donations paid out on a monthly basis
4.4 Transparency in Donation Tracking The Platform is committed to transparency and accountability in the tracking and use of donations. To uphold this commitment:
Detailed records of donations are maintained, providing clear trails for how funds are attributed and disbursed.
The Platform regularly reviews its processes and provides updates to ensure continuous improvement in the management and tracking of donations.
4.5 Compliance with Financial Regulations In managing payments and donations, the Platform complies with all relevant financial regulations, including:
Anti-Money Laundering (AML) standards.
Know Your Customer (KYC) requirements.
Financial Conduct Authority (FCA) guidelines, as applicable.
The Platform’s compliance ensures the integrity of the donation process, safeguarding against financial misuse and ensuring that the generosity of donors achieves the intended philanthropic impact.
Part 5 – Protecting Your Account
5.1 Responsibility for Account Security The integrity and security of user accounts are paramount to the Platform. Users are solely responsible for safeguarding their account information, including usernames and passwords. The Platform provides tools and features to enhance account security, but it is the user's duty to:
Maintain the confidentiality of account credentials.
Use complex passwords and change them regularly.
Avoid sharing account details with third parties.
5.2 Implementation of Security Measures The Platform employs robust security measures to protect user accounts and data, which include:
Secure server infrastructure.
Encryption of sensitive data in transit and at rest.
Regular security audits and updates to stay ahead of potential cyber threats.
5.3 Two-Factor Authentication (2FA) To further enhance account protection, the Platform offers two-factor authentication, which adds an additional layer of security by requiring a second form of verification beyond just the password. Users are strongly encouraged to enable 2FA to protect against unauthorised access. This will be a requirement for all Charity accounts. *while in beta testing this has not yet been introduced
5.4 Monitoring and Reporting Suspicious Activity Users are expected to monitor their accounts for any unauthorised or suspicious activity. The Platform provides notifications for account access and transactional alerts. Any unusual activity should be reported immediately to the Platform’s support team at security@lief.world
5.5 Recovery of Compromised Accounts In the unfortunate event of an account compromise, the Platform has procedures in place to assist users in recovering their accounts, which include:
Verification of the user’s identity.
Temporary suspension of account access to prevent further unauthorised activity.
Guided steps for users to regain control of their accounts and secure them.
Part 6 - User Conduct and Content
6.1 Standards of Conduct Users of the Platform are expected to conduct themselves in a manner that is respectful, responsible, and in full compliance with both the letter and spirit of this Agreement. Users shall not:
Engage in unlawful, fraudulent, or deceptive activities.
Partake in acts that are discriminatory, harassing, defamatory, or otherwise harmful to others.
Use the Platform in any way that could damage, disable, overburden, or impair the functioning of the Platform or any user’s enjoyment of the Platform.
6.2 Prohibited Activities In alignment with Stripe's policies and to maintain the integrity of the Platform, the following activities are strictly prohibited:
Processing payments related to business categories that are restricted by Stripe, as detailed in the Stripe Services Agreement.
Engaging in any transactions involving illegal goods or services or any other activities that would violate applicable law.
Misrepresenting your identity is strictly prohibited.
6.3 Content Guidelines User-generated content, including but not limited to comments, posts, and campaign descriptions, must adhere to the following guidelines:
Content must be accurate, and users should refrain from posting misleading information.
Content must not contain language that is profane, offensive, racist, defamatory or constitutes hate speech.
Users must respect the intellectual property rights of others; thus, content must not infringe upon anyone's copyright, trademark, or other intellectual property rights.
6.4 Platform Content Moderation The Platform reserves the right, but not the obligation, to:
Monitor, review, or edit any user-generated content.
Remove any content that is deemed to be in violation of this Agreement or that may pose a risk to the safety and well-being of others.
Take appropriate action against any user or content that violates the terms of this Agreement, which may include suspension or termination of the user's account.
6.5 Reporting Violations Users are encouraged to report any content or behaviour that they believe violates this Agreement to the Platform’s support team via support@lief.world. Link The Platform commits to evaluating all reported violations seriously and to taking the necessary action to maintain a safe and respectful environment.
6.6 Responsibility for Content Users acknowledge that they are solely responsible for the content that they post on the Platform and the consequences of sharing or publishing such content. The Platform will not be responsible or liable for user-generated content.
6.7 Compliance with Legal Requests The Platform will cooperate with law enforcement and comply with legal requests when required by law, which may involve disclosing user information and content as part of legal processes.
Part 7 - Refunds and Dispute Resolution
7.1 Refund Policy The Platform facilitates donations to charitable organisations and understands that there may be rare instances where a donor requests a refund. The refund policy is as follows:
Direct Refund Requests: The Platform will only assist with refunds if written consent is provided by the Charity that the donation is made to. Refunds will only be possible if the funds have not already been paid out. In this case, refunds must be taken up directly with the Charity and processed by them.
7.2 Refund Processing For refunds processed through the Platform, the following applies:
The original transaction fees and voluntary contribution may not be recoverable, and the net amount, after deducting any such fees, will be considered for refund.
The Platform will communicate transparently with all parties involved throughout the refund process.
7.3 Dispute Resolution Mechanism In the event of disputes arising from the use of the Platform, the following resolution process will be initiated:
Users should report the dispute to the Platform by contacting disputes@lief.world Link providing detailed information about the nature of their concern.
The Platform will evaluate the submitted information and may request additional documentation or clarification from the parties involved.
Efforts will be made to facilitate an amicable resolution between the disputing parties. If the dispute involves payment processing, the Platform may involve Stripe to ensure compliance with their policies and procedures.
7.4 Role of the Platform in Disputes The Platform acts as a facilitator in the resolution process and does not serve as an arbitrator or legal authority. The Platform's role includes:
Assisting in the communication between the User and the charity to reach a mutual understanding.
Advising on potential solutions based on the Platform's policies and industry best practices.
7.5 Legal Compliance in Disputes All parties are expected to adhere to applicable laws and regulations when resolving disputes. The Platform will not tolerate any illegal activities and will cooperate with law enforcement if necessary.
7.6 Limitations on Platform’s Liability While the Platform endeavours to assist in dispute resolution, it is not liable for:
The outcome of any dispute.
Any direct or indirect consequences that arise from the resolution process.
7.7 Record-Keeping The Platform maintains records of all disputes and resolutions for accountability and to assist in the continuous improvement of the Platform's services.
Part 8 - Compliance with Stripe Agreement
8.1 Adherence to Stripe Connected Account Agreement As a platform that facilitates charitable donations, Lief World Ltd is committed to strict adherence to the Stripe Connected Account Agreement, which governs the provision of payment processing services by Stripe to platform users and partners. By using the Platform’s payment processing services, you agree to comply with all applicable terms and policies set forth by Stripe, including but not limited to:
Compliance with Stripe’s Service Terms: Users must conduct transactions in accordance with the terms of service provided by Stripe.
Prohibited Businesses and Activities: The Platform, in alignment with Stripe’s policies, restricts certain types of businesses and activities from using the payment services. Users must not engage in any activities that are prohibited by Stripe, as these could affect the integrity of the payment services.
8.2 Transactional Integrity and Review The Platform ensures that:
All payment transactions are subject to review and validation by Stripe. Users acknowledge that Stripe has the authority to decline a transaction if it does not comply with their policies or appears to be suspicious or fraudulent.
Users must provide accurate and complete information about themselves and their transactions when using the payment services.
8.3 User Responsibility in Stripe Compliance It is the responsibility of the User to:
Understand and adhere to the Stripe Connected Account Agreement. The Platform will provide guidance and support where possible, but ultimate compliance with the agreement lies with the User.
Ensure that their use of the payment services aligns with all legal and regulatory requirements related to their activities on the Platform.
8.4 Data Sharing with Stripe In accordance with the Stripe Connected Account Agreement, the Platform may share transactional data and user information with Stripe to the extent necessary for the facilitation of payment processing services. This includes:
Sharing necessary personal and transactional information with Stripe for the purposes of anti-money laundering checks, fraud monitoring, and other security purposes.
Ensuring that any data shared with Stripe is done so in compliance with applicable data protection laws and regulations, including GDPR.
8.5 Changes to Stripe’s Agreement The Platform will make reasonable efforts to inform Users of any changes to Stripe’s Connected Account Agreement that may affect the use of payment services on the Platform. Users are also encouraged to review Stripe’s policies regularly to stay informed of any updates.
8.6 Cooperation with Stripe The Platform will cooperate fully with Stripe in all matters related to payment processing, including but not limited to investigations of fraud, illegal activities, or breaches of the Stripe Connected Account Agreement. Users may be required to provide additional information or take specific actions to assist in these matters if requested by Stripe or the Platform.
Part 9 – Modifications to Terms and Service
9.1 Right to Amend Lief World Ltd reserves the right to modify, adjust, or amend any terms and conditions of this User Agreement at any time to reflect changes in legal or regulatory requirements, adjustments in the services offered, or for any other reason deemed necessary by the Platform for its operational efficiency or compliance obligations. Any and all new features the Platform release will be subject to these Terms and Conditions.
9.2 User Responsibility It is the User’s responsibility to stay informed about the Agreement and any changes that may affect their use of the Platform. Ignorance of the updated terms will not be a valid excuse for non-compliance.
Part 10 – Failure to Comply and Termination
10.1 Non-Compliance Should a User fail to comply with any of the terms and conditions set forth in this Agreement or any other policies that govern the use of the Platform, Lief World Ltd reserves the right to take appropriate actions to enforce compliance. Such actions may include, but are not limited to, issuing a warning, suspending or limiting access to the Platform’s services, or terminating the User's account.
10.2 Termination by User Users may terminate their relationship with the Platform at any time. The terms will still apply to any past use.
Part 11 – Liability and Indemnity
11.1 Limitation of Liability Access to and use of the Platform and its services are on an 'as is' and 'as available' basis, at your own risk. We strive for, but cannot guarantee, uninterrupted and secure access due to external factors beyond our control. Our Terms of Service outline specific rights, guarantees, and remedies, but beyond those, we offer no additional warranties or terms to the extent permitted by law. Regular maintenance and updates may result in temporary unavailability of the Platform. In rare cases, unforeseen factors may cause further unavailability. Under applicable law, Lief World Ltd is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses. This includes damages resulting from:
Your access to, use of, inability to access, or inability to use the Platform.
Any unauthorised access, use, or alteration of your transmissions or content.
Any conduct or content of any third party on the Platform, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties.
Any content obtained from the Platform.
This applies to liability based on contract, tort, negligence, strict liability, or any other legal theory, regardless of whether Lief World Ltd has been informed of the possibility of such damage."
11.2 Indemnification by User You agree to defend, indemnify, and hold harmless Lief World Ltd and its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:
Your violation of this Agreement.
Your access to, use of, or alleged use of the Platform.
Your violation of any rights of a third party, including but not limited to any copyright, trademark, privacy, or other proprietary rights.
Any harm or damages caused by your actions or omissions.
11.3 No Waiver The failure of Lief World Ltd to enforce any right or provision in this Agreement will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. This means that Lief World Ltd’s legal rights relating to enforcement will still be available despite any past failures to enforce such rights.
11.4 Force Majeure Lief World Ltd shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Lief World Ltd’s reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation.
11.5 Severability If any provision of this Agreement is found to be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from this Agreement and will not affect the validity and enforceability of any remaining provisions.
Part 12 – Gift Aid and Tax
12.1 Gift Aid For Users who are UK taxpayers, the Platform facilitates the use of the Gift Aid scheme, which allows charities to reclaim tax on a donation made by a UK taxpayer, effectively increasing the value of the donation. To enable this:
Users must complete a Gift Aid declaration, confirming their tax payer status and that they wish to apply Gift Aid to their donation.
The Platform will provide the necessary information to the charities to claim Gift Aid on qualifying donations.
12.2 Tax Implications of Donations Users are responsible for understanding the tax implications of their donations. The Platform provides general information, but this does not constitute tax advice. Users should:
Consult with a tax professional to understand the tax benefits and requirements pertaining to their contributions.
the Platform maintains records of donations and make these available to the user from their profile.
12.3 Compliance with Tax Laws The Platform is committed to full compliance with all relevant tax laws and regulations. In cooperation with Users and charities, the Platform will provide necessary documentation and reports that may be required for tax reporting and compliance.
12.4 Representation of Taxpayer Status By claiming Gift Aid, Users represent and warrant that they:
Have paid or will pay an amount of Income Tax and/or Capital Gains Tax for each tax year that is at least equal to the amount of tax that all the charities or Community Amateur Sports Clubs (CASCs) to which they donate will reclaim on their gifts for that tax year.
Understand that other taxes such as VAT and Council Tax do not qualify for Gift Aid.
Are responsible for paying any difference if they have not paid sufficient tax to cover the Gift Aid claimed on their donations.
12.5 Changes to Tax Laws Should there be any changes to tax laws that affect the application of Gift Aid or the tax implications of donations made through the Platform, the Platform will update its procedures and inform Users accordingly. Users must comply with any new tax regulations that come into effect.
12.6 Responsibility for Non-Compliance If a User makes a declaration that they are a UK taxpayer and it is later determined that they are not, the User will be responsible for any resulting obligations or liabilities. This includes any claims made by tax authorities for repayment of Gift Aid amounts.
Part 13 – Governing Law
13.1 Applicable Law This Agreement, and any dispute arising from the relationship between the parties to this Agreement, shall be governed by and construed in accordance with the laws of England, excluding any laws that direct the application of another jurisdiction’s laws.
13.2 International Use We make no representation that information on the Platform is appropriate or available for use outside of England. Those who choose to access the Platform from outside England do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
Part 14 - Privacy
The Platform is committed to protecting the privacy and security of user data in compliance with GDPR and other relevant privacy laws. The Platforms Privacy Policy forms part of these Terms. By using our platform and whereby agreeing to these Terms, you agree to way we handle your personal information and data. See our Privacy Policy.
Part 15 - Acceptance of Terms
15.1 Acknowledgment of the Agreement By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by the terms of this User Agreement. You further agree that this Agreement represents a complete and exclusive statement of the agreement between you and Lief World Ltd, superseding any proposal or prior agreement, oral or written, and any other communications between you and Lief World Ltd relating to the subject matter of this Agreement.
15.2 Use on Behalf of Organisation or Charity If you are using the Platform on behalf of a company, entity, or organisation (collectively "Subscribing Organisation"), then you represent and warrant that you:
Are an authorised representative of that Subscribing Organisation with the authority to bind such organisation to these terms;
Have read the foregoing terms;
Have read and accepted the terms of this Agreement, and agree to it on behalf of the Subscribing Organisation and accepted these terms on initial sign up.
15.3 Continuous Agreement This Agreement is in effect until your use of the Platform services is terminated by either party. You agree that your account is non-transferable and any rights to your account or contents within your account terminate upon your death. Upon termination of your use of the Platform, your agreement with Lief World Ltd also terminates.
15.4 Changes to the Platform Lief World Ltd reserves the right at any time to modify or discontinue, temporarily or permanently, the Platform (or any part thereof) with or without notice. You agree that Lief World Ltd shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Platform.
15.5 Agreement to Receive Communications By using the Platform, you agree to receive electronically all communications, agreements, documents, notices, and disclosures that we provide in connection with the Platform ("Communications"). We will provide these Communications by posting them on the Platform or by emailing them to you at the email address listed in your account.
15.6 Entire Agreement This Agreement, and any other legal notices published by Lief World Ltd on the Platform, shall constitute the entire agreement between you and Lief World Ltd concerning the Platform. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.
